U.S. Department of Education Acts on School Safety Report Recommendation to Improve Understanding of Student Privacy Law

On February 12, 2019, the U.S. Department of Justice issued a set of FAQs in response to a School safety report and recommendation to improve understand of the Federal Educational Rights to Privacy Act (FERPA) as it applies to situations involving school safety and emergencies. The FAQ addresses school official’s responsibilities under FERPA and its application in situations involving a school based threat. The FAQ covers commonly asked questions relating to the application of FERPA to law enforcement, threat assessment teams, permitted disclosures in emergency situations, and personal observations of school officials.
