Updated Guidance from the USDE on Campus Sexual Assaults (November 2017 School Leader Update)
On Sept. 22 the United States Department of Education (USDE) withdrew its Dear Colleague Letter on Sexual Violence dated April 4, 2011. The withdrawal was accompanied by new interim guidance on Campus Sexual Misconduct that includes a Q&A on Campus Sexual Misconduct. "This interim guidance will help schools as they work to combat sexual misconduct and will treat all students fairly," said Secretary of Education, Betsy DeVos. "Schools must continue to confront these horrific crimes and behaviors head-on. There will be no more sweeping them under the rug. But the process also must be fair and impartial, giving everyone more confidence in its outcomes."
USDE will engage in a rulemaking on Title IX responsibilities arising from complaints of sexual misconduct. During this process stakeholders will be able to provide public comment on the proposed rules.
