FERPA Guidance on the USA

The Uninterrupted Scholars Act (USA), which amended the Family Educational Rights and Privacy Act (FERPA) was enacted in 2013. These amendments also affected the confidentiality provisions in 20 U.S.C. § 1417(c), which apply to Parts B and C of the Individuals with Disabilities Education Act (IDEA). On May 27, 2014, the U.S. Department of Education issued guidance to state and local officials, as well as other education stakeholders with information to implement the changes made by the USA to FERPA and IDEA’s Part B and C confidentiality provisions.
