Eligible students whose conditions keep them from participating in the general and special education provided in schools or related facilities shall be provided special education instructional and support services in a home or hospital setting.

A need for itinerant services in a home or hospital setting must be determined at a meeting to develop or revise the individual’s IEP, and parents must give consent or be given notice, as appropriate.

Home or hospital instructional services shall be provided by the LEA but may, through a contract, be provided by the AEA or another qualified agency.

Home or hospital support services are usually provided by the AEA but may be provided by the LEA or another qualified agency.

It should be noted that whether the service is provided by the LEA, AEA or another qualified agency the LEA is responsible for the ensuring that the services are provided.

If a student is eligible for special education and in need of home or hospital instructional services an IEP meeting must be held to determine how services will be delivered.

If the student currently has an IEP, a review or Amendment IEP meeting must be held to changes the services provided to the student.

If the student was not previously identified as a student with a disability but has been determined to be eligible for special education services an initial IEP meeting must be held. Initial IEPs

The provision of services in a home or hospital setting shall satisfy the following:

• The service and location of the service shall be specified in the individual’s IEP.
• The status of these individuals shall be periodically reviewed [determined by IEP team] to verify the continuing need for and the appropriateness of the service.
• Procedural safeguards shall be provided to individuals receiving special education through itinerant services in a home or hospital setting.
